Welcome to The Vacation Wizards! These Terms and Conditions (“Agreement”) govern the use of our services and website. By booking a vacation package, you agree to the terms outlined in this document. Please read these terms carefully before making any bookings.

1. ABOUT THE VACATION WIZARDS

The Vacation Wizards is a travel agency based in Alabama that specializes in planning magical vacations to destinations like Disney, Universal Studios, cruises, and all-inclusive resorts. We are dedicated to providing personalized travel experiences to ensure our clients have unforgettable trips.

2. USING OUR SERVICES

We provide our Services to help you find information about various travel destinations and to assist you in booking travel to those destinations. It is provided to you for no other purpose.

You agree that:

  • You will only use our Services in accordance with these terms and conditions;

  • You must be at least 18 years of age and have the legal authority to enter into contracts;

  • All information supplied by you is true, accurate, current, and complete.

 

3. SERVICES PROVIDED

We offer the following services:

  • Booking of Disney, Universal, and other theme park tickets and accommodations.

  • Cruise bookings with various cruise lines.

  • Reservations for all-inclusive vacation packages.

  • Customized vacation planning services, including itinerary creation and recommendations for activities.

 

All services are provided by The Vacation Wizards, and our goal is to ensure your travel experience is seamless and enjoyable. You understand that The Vacation Wizards is not the source or supplier of the travel services you have requested and acts solely as the booking agent for the actual suppliers of such services. You agree that the suppliers whose names appear in the information supplied to me are those who are responsible for providing the travel services you have booked. You consent to and request the use of those suppliers and agree not to hold The Vacation Wizards responsible should any of these suppliers: 1) fail to provide the travel services you have booked; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes you or your traveling party any sort of injury, damage, delay or inconvenience.

4. BOOKING PROCESS

  • Reservation Request: To begin the booking process, you must complete a request for your desired travel package. Our agents will provide you with a personalized itinerary and pricing.

  • Deposit and Payment: For most bookings, a deposit will be required to secure your reservation. The specific amount will depend on the nature of the booking (e.g., cruises, resorts, theme parks). Full payment is due by the specified due date, which will be outlined in your booking agreement. Failure to make timely payments may result in the cancellation of your reservation. 

  • Cancellation and Changes: Once booked, reservations may be subject to cancellation fees or penalties. Each provider (Disney, Universal, cruise lines, resorts) has its own cancellation policy, which will be communicated to you at the time of booking. If you need to make changes, we will work with you to accommodate them, subject to availability and applicable fees.

  • Travel Documents: Travel documents, such as tickets, itineraries, and vouchers, will be provided after full payment is received. It is your responsibility to ensure all information is correct upon receipt.

 

5. PRICING AND FEES

  • Pricing: All prices quoted by The Vacation Wizards are based on availability at the time of booking and are subject to change. The final price is determined upon confirmation of booking and may change due to fluctuations in availability or special promotions.

  • Service Fees: The Vacation Wizards charges a service fee for customized vacation planning and booking services. This fee will be clearly communicated during the planning process. Any additional costs or service fees imposed by third-party vendors (such as Disney or cruise lines) will be outlined in your booking details.

  • Taxes and Fees: All applicable taxes, resort fees, and port fees will be added to your invoice. These fees are not included in the quoted prices and are the responsibility of the traveler. 

 

6. TRAVEL INSURANCE

While travel insurance is not mandatory, we highly recommend it to protect your investment in case of trip cancellation, medical emergencies, or unexpected changes in your travel plans. We can provide information on various travel insurance options at your request. Agents of The Vacation Wizards are not licensed insurance agents, and it is your responsibility to understand any insurance policy and ask any detailed questions directly to the travel supplier. You understand that travel insurance has been offered to me for purchase to cover certain risks inherent in travel such as supplier bankruptcy, trip interruption and/or the inability to travel due to a medical or personal emergency. If you choose not to purchase travel insurance or if you purchase travel insurance on your own (not through The Vacation Wizards), The Vacation Wizards requires that you confirm or decline insurance in writing via our agency forms, email, text message, or other written correspondence.

7. TRAVEL REQUIREMENTS

  • Passports and Visas: For international travel, it is your responsibility to ensure you have a valid passport and any necessary visas. We recommend that you verify the entry requirements for your destination before booking. Passport and visa information may be obtained by contacting the Travel Advisory Section of the US State Department at 202.647.5225 or by visiting the State Department’s website at travel.state.gov. Non-US passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements.

  • Health and Safety: You are responsible for complying with health and safety guidelines provided by travel suppliers (such as cruise lines, resorts, and theme parks). Some destinations may require vaccinations or health documentation, and it is your responsibility to ensure you meet these requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s website at www.cdc.gov. 

  • Special Needs or Requests: If you or anyone in your party has special needs or requests (e.g., wheelchair accessibility, dietary restrictions), you must notify us as soon as possible. We will do our best to accommodate these needs with the travel providers.

8. RISKS AND SAFETY

Travel to certain destinations may involve greater risk than others. The Vacation Wizards urges Clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/.

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, The Vacation Wizards DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT THE CLIENT’S OWN RISK.

Certain activities that are included as part of the itineraries that we book pose inherent risks and may be dangerous. Your itinerary may also involve travel to remote areas without access to medical facilities or treatment, changing weather conditions, interactions or encounters with wildlife, and other potentially dangerous conditions. By booking a trip with The Vacation Wizards, you acknowledge that you are aware that the physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You acknowledge that you should seek medical advice if you know or suspect that your physical condition may be incompatible with the activities on your itinerary. You may be required to wear approved safety equipment while participating in certain activities, you agree to use the recommended safety equipment and to ask questions if you are unsure about how to properly or safely use equipment.

If you use, consume, or are under the influence of alcohol or illegal drugs prior to or while engaging in any activities on your itinerary, YOU ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS THAT MAY RESULT INCLUDING THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS, even in the event of negligence or fault by The Vacation Wizards or third parties, and you indemnify The Vacation Wizards from any and all liability for any damage to property or personal injury to any third party, resulting from your participation in the Activities, while, during, or after consumption of illegal drugs or alcohol.

9. AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN

If your travel includes flying, your airline ticket is a contract between you and the air carrier, even if you purchase through The Vacation Wizards. If you purchase air travel through The Vacation Wizards, you acknowledge and agree that The Vacation Wizards does not have the right to control the operations of independent airlines, and agree that The Vacation Wizards is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.

The Vacation Wizards shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares

10. LIMITATIONS OF LIABILITY AND RESPONSIBILITY

The Vacation Wizards acts solely as an intermediary for third-party vendors, including cruise lines, theme parks, resorts, and airlines. We do not directly operate, own, or control any travel services. Our liability is limited to the services we provide in facilitating the booking and planning of your trip.

The Vacations Wizards is not responsible for:

  • Any delays, cancellations, or other issues related to third-party service providers (e.g., airlines, cruise lines, hotels).

  • Lost or damaged baggage.

  • Acts of God, such as weather disruptions, natural disasters, or strikes.

  • Travel disruptions due to unforeseen circumstances such as pandemics, government restrictions, or force majeure.

 

By booking through The Vacation Wizards, you agree to hold us harmless for any such issues that arise during travel by you or your party. The Vacation Wizards shall not be liable for any injuries or any damage to you or any of your party or be subject to any claim, demand, injury, or damages, whatsoever, including without limitation, those damages from acts of passive or active negligence on the part of The Vacation Wizards, its officers, employees, or agents. You hereby release and discharge The Vacation Wizards from all such claims, demands, injuries, damages, actions or causes of action arising out of any travel booked through The Vacation Wizards. You acknowledge that you has carefully read this paragraph and fully understand that this is a waiver and release of liability and have explained such to everyone in your traveling party.

BECAUSE The Vacation Wizards ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT The Vacation Wizards IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. The Vacation Wizards HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH The Vacation Wizards, INCLUDING WIHTOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFULL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTICY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF The Vacation Wizards’ CONTROL, AND YOU HEREBY EXONERATE The Vacation Wizards FROM ANY LIABILITY WITH RESPECT TO THE SAME. The Vacation Wizards HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM The Vacation Wizards WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY The Vacation Wizards.

 

11. CODE OF CONDUCT

You are expected to behave respectfully and responsibly when traveling. Any behavior that disrupts the enjoyment or safety of others, or that violates the terms of service of the travel providers, may result in cancellation of your trip or other penalties. Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places you visit. In any such case, there will be no refund.

Any transportation, possession or use of illegal drugs may result in immediate termination of your trip and may result in prosecution by law enforcement authorities. You are responsible for knowing and observing the licensing laws for drug possession (including prescription and over the counter drugs) for all countries and states you are visiting. Laws may require you to carry a prescription from your doctor for certain medications.

12. PRIVACY POLICY

We value your privacy and are committed to protecting your personal information. Any information collected during the booking process will be used solely for the purpose of managing your travel plans. We will not sell or share your personal information with third parties, except as necessary to fulfill your travel arrangements.

13. CHANGES TO TERMS AND CONDITIONS

The Vacation Wizards reserves the right to update these Terms and Conditions at any time. Any changes will be posted on our website with an updated effective date. It is your responsibility to review the Terms and Conditions periodically.

14. GOVERNING LAW

This agreement is governed by and construed in accordance with the laws of the State of Alabama. Any disputes arising from this Agreement shall be resolved in the courts located in the State of Alabama.
